Le nuove disposizioni in tema di prospezione, ricerca e coltivazione di idrocarburi e le problematiche giuridiche connesse
Il presente lavoro si propone, previa una breve esposizione dell’evoluzione normativa che ha interessato la materia degli idrocarburi ed un primo inquadramento concettuale delle diverse tipologie di attività di c.d. "upstream" minerario (ossia, prospezione, ricerca e coltivazione), di offrire una lettura critica delle nuove disposizioni intervenute in materia per opera del d.l. 12 settembre 2014, n. 133 (c.d. "Sblocca-Italia"). In particolare, si cercherà di mostrare la tensione (oggi) esistente nel settore fra due opposte esigenze che richiedono, soprattutto all’interprete, un’opera di attento bilanciamento: ci si riferisce, da un lato, al bisogno di rilancio delle attività economiche connesse allo sfruttamento energetico, e, dall’altro, alle esigenze di (forte) protezione ambientale ed ecologica (soprattutto delle "aree marine protette") alla luce dei principi di "precauzione" nonché di "sviluppo sostenibile". In tale contesto si è inserita, di recente, la (nuova) disciplina posta dal Governo italiano all’interno dell’art. 38 del decreto "Sblocca-Italia", la quale, come si cercherà di mostrare nel corso dell’analisi, pare presentare alcune criticità , tanto sotto il profilo della compatibilità a Costituzione (specialmente quanto al rispetto dei criteri di riparto di competenze, legislative ed amministrative, fra Stato e Regioni), quanto con la disciplina sovranazionale (ed, in particolare, comunitaria) dedicata al (delicato tema) della protezione ambientale legata alle attività estrattive c.d. "offshore".After a brief exposure of the regulatory changes that affected the hydrocarbons and after a first conceptual framework of the different types of "Upstream" activities (ie, prospecting, exploration and production), the paper aims to offer a critical interpretation of the new provisions of the law decree of September 12th, n. 133/2014 (so called "Sblocca-Italia"). In particular, it will be shown the contrast today existing between two opposite needs: on one hand, the need of economic recovery linked to the energy exploitation and, on the other hands, the need of (strong) environmental and ecological protection (especially of "marine protected areas") in the light of the principles of "precaution" and "sustainable development". In this framework, the (new) rules laid down by the Italian government in the Art. 38 of the Decree "Sblocca-Italia", seem to be problematic, both in terms of compatibility with the Constitution (especially as to the compliance with the criteria of the allocation of legislative and administrative competences between State and Regions), and in relation with the supranational regulation (in particular communitarian) dedicated to the (sensitive issue) of the environmental protection in the so called "mining offshore" activities
Il PON Reti e MobilitĂ e gli obiettivi di SostenibilitĂ : il ruolo del Piano di Monitoraggio Ambientale
The National Operative Program (PON) “Reti e mobilità ” has been
approved by European Commission on the 7th of December 2007.
The strategic approach of the PON, exclusively devoted to the socalled
“convergence regions” of Italy (Campania, Calabria, Sicilia, Puglia),
aims to:
1. improve the modal balance by an economic, social and environmental
perspective;
2. develop the inter-modality in order to move towards the integration
of convergence area into the network of the European transport
system;
3. improve the mobility and the accessibility, also to reduce the traffic
congestion;
4. increase the efficiency related to security standards, to management
techniques and to the quality of transportation services in the sector
of freight;
5. guarantee the reduction of environmental impacts through a global
improvement of the efficiency of the transport systems.
In such a way it is clear that the PON “Reti e mobilità ” takes greatly into
account the Sustainability principles recognized at European scale as
attested by the budget, namely over the 70% of the entire fund,
associated with low-impacts infrastructures (railways and harbors).
The PON has been submitted to the SEA procedure, following what the
2001/42/CE Directive establishes.
The Environmental Report of PON devotes great attention to the
monitoring activity as shown by the reported recommendation about
the need for adequate measures for the environmental monitoring, also
in order to apply corrective measures during the implementation of the
program. By this point of view, a first and important step has been the
elaboration of the “Environmental Monitoring Plan” (EMP) that represents
the main methodological document for the following implementation
of the monitoring activity.
This paper, after a brief presentation of the program and of the objectives
of Sustainability that the Programs aims to pursue through the realization
of specific projects, is devoted to introduce the Environmental
Monitoring Plan of the PON that has been approved by the Ministry of
the Infrastructures and Transport -in charge as Management Authority
of the PON- in February 2011. In detail, the PMA represents the tool
through which, the Management Authority, that has specific
responsibilities and functions in terms of monitoring and environmental
assessment of the program, controls the significant impacts on the
environment caused by the implementation of the PON and verify the
level of achievement of the established objectives of environmental
sustainability. The structure of EMP is based on three main aspects:
1) the adoption of the results of other interesting experiences carried
out by experts institutions on the topic;
2) an approach favoring the creation of an “integrated” monitoring system
with the others Operative Programs activated at regional scale;
3) the implementation of a cooperation and shared process with all the
directly-involved actors

Sono state, inoltre, riportate le modalit? di utilizzo del Fondo nazionale di intervento per la lotta alla droga al fine di avere una panoramica complessiva degli interventi. La terza parte prende in considerazione ed approfondisce argomenti di particolare interesse, legati alla situazione del nostro Paese nei confronti del problema della diffusione dell\u27uso e abuso di sostanze illegali, facendo riferimenti e confronti con altri Paesi dell\u27Unione europea. Negli allegati, infine, trovano spazio documenti di pratica utilit?, come le tavole statistiche, la bibliografia di riferimento aggiornata e ragionata e gli indirizzi dei siti Web, nazionali ed internazionali, di maggiore interesse ed utilit? nel settore delle droghe illegali e delle tossicodipendenze

The conservation of industrial architectures and the refurbishment project, must take into
account the growing attention to the seismic risk of the built heritage, which the recent events
of central Italy have made dramatically current. The different constructive nature and structural
behavior of industrial buildings, impose a different approach, combining the new functional
needs - and therefore the safety of the building - with its conservation as a testimony for future
generations. The work focuses the Friulian textile industry buildings (XIX and XX century),
studying their constructive techniques and identyfing some guidelines for the refurbishment
